The Elementary and Secondary Schools Emergency Relief and American Rescue Plan (ESSER III-ARP) grant includes a Maintenance of Equity (MOEquity) provision. LEAs receiving ESSER III-ARP funding are required to comply with the MOEquity provision. The MOEquity provision is a condition of receiving ESSER III- ARP funding that requires LEAs to not disproportionately reduce:
- State and local per-pupil funding in high-poverty schools
- The number of full-time-equivalent (FTE) staff per-pupil in high-poverty schools
LEAs are exempt from meeting MOEquity requirements if they did not have an aggregate reduction in combined State and local per-pupil funding in FY23.
